The Company needs to apply its profits if any or other income in promoting its objects and cannot distribute the payment of any dividend to its members. 

  1. Ownership 

The Trustee is the legal owner of the Trust, members have the ownership of Society while the shareholders have the ownership of Company.

The setting up process for Public Trust takes between two to three months. The registration is required with Deputy Charity Commissioner of the relevant region. Minimum 2 trustees are required at the time of registration. For Private discretionary Trust, there is no process of registration. It can be created by the execution of Trust Deed.

It is difficult to modify objects of the Trust and impossible in case of original settlers being not present or unwilling to do the same. 

Objects in Society can be modified with the approval of 3/5ths of the members while in the case of Company it can be modified anytime subject to the approval of Central Government.

The management control of a Trust is by trustees as appointed under the Trust Deed. 

The Governing Council as elected by the society members has the control and management of a Society while in case of Company the control is in the hands of Directors as appointed by the shareholders.

Establishing operational control is the responsibility of Trustees in line with the Trust Deed. 

Governing councils/directors / committee take charge of the operational control in Society whereas in Company the operational control is with the Directors in line with the MOA and AOA. 

  1. Members Participation 

Trustees make decisions and have the final say whereas in case of Society and Company, members participation is as stated in the MOA. Further in case of Company, the rights of the shareholders are governed by the Companies Act.

  1. Termination 

As per the rule, a Trust can be dissolved by the Settlor. 

Any number not less than 3/5th of the members is required to dissolve a Society whereas in case of Company, winding up is a time consuming process. It can take anywhere between 10-12 months. 

  1. Funding (Foreign Contribution Regulation Act)

If grants are received directly by the Trust, Society or Company from overseas, approval of Ministry of Home Affairs under Foreign Contribution Regulation Act is required. The entire process is time-consuming and can take anywhere between four to six months. So, the funding process is similar in all three cases. 

The only exception is in case of a foreign trustee as the credibility of the foreign trustee needs to be established before the regulator. 

  1. Repatriation of funds 

Profits or funds in case of Society and Trust can be utilized for the advancement of their objectives. While any form of repatriation is not possible in case of Company, the same is possible with a RBI approval in case of a Trust.

  1. Exchange Control/ FDI policy 

For setting up an Indian Trust, the easier route is to not have a foreign trustee or beneficiary. In case it does, then the provisions of exchange control applies to the Trust.

In the presence of a foreign trustee, the registration of Trust’s  immovable properties would require prior approval from RBI. As a non resident is not permitted to own immovable property in India, the same will not be possible.

Further in the presence of a foreign beneficiary, prior RBI approval is required to make remittances in future and distribution on dissolution of the trust. Such an approval is extremely difficult.

In case of a Company, the ownership of stock is governed by the FDI policy of the Government of India. According to the same, certain activities fall under the direct route, that is, no approval is required for them. For instance, educational research, tendering scholarships, publishing of books. Further, AICTE and University Grant Commission guidelines prohibit a Company from setting up a college, university or any educational institution

  1. Transfer of Ownership 

Transfer of ownership is not permissible in case of Trust while it is permitted in Society with the appointment of new members and resigning of old members. The same should be approved by 3/5ths members resolution. 

Company allows transfer of ownership by transfer of shares.

Increasing Wellness In Students

I believe that investing in our children’s development from the earliest age is the single most important contribution we can make as parents, teachers, and mentors. Young minds are very fragile and vulnerable, and they are influenced entirely by their environment and the family. Wellness for students encompasses a healthy body, a sound mind, and a very peaceful and tranquil spirit. Guiding our children and showing them a way on this path of wellbeing is surely our moral duty.

I am reminded of an incident when I met a student at his cousin’s wedding. Udit is a father of two and works in Melbourne. Catching up with him I noticed that his eyes became moist and he thanked me. He told me that during our Physics classes I had shared a couple of anecdotes and stories about life and its purpose. Udit took me by surprise when he said that those words left an indelible mark on him and he has since felt very evolved exploring spirituality and philosophy. Coming from a young successful NRI, it was a pleasant surprise and all we could do as two individuals was to share a warm hug!  I realised with great humility that our words, gestures, knowledge, experiences as teachers or mentors go a long way. When and where we leave our impression is indeed a puzzle.

The 4 Magic A’s in your Pandemic Tool Kit

Enough has been said and discussed about the pandemic and how it has us all in grips of fear and anxiety. The precautions to be taken to keep oneself safe from the virus. New vocabulary has been introduced to our everyday conversation. Children as young as preschoolers are now talking about “Social Distancing” and the “New Normal”.

When they look back, twenty years from today, what is it that they will remember? Are they going to look back at the year that was 2020 and shudder in remembered fear, or will they have memories of how humanity came together to come through these trying times?

And that is the essence of this passage.

As parents, teachers and caregivers, it is time to reflect, not only about what is to be done right now, but also about the future our young children are heading towards.

While physical well-being is the focus right now, we must also look at how we can keep our children emotionally strong. And this can be done only if the adults around them work together.

Here are some suggestions to enable this. And we call it the 4 A’s that will see you through!

The first “A” is Awareness. It is important that we make ourselves Aware of the reality that is. Understanding the situation in totality will help us sift through the unending information that is bombarding all media handles. It will help us keep our balance and reduce our anxiety. Not everything that is published is authentic. Check for accuracy of information and validate it by checking authentic websites, such as the WHO, CDC and the IMA. Refrain form forwarding messages that trigger panic and anxiety. Stop the spread, not just of the virus, but also of these morbid messages.

The second “A” is Acceptance. The situation is what it is. Accept it. The sooner we move to accepting the situation, the sooner we will find ways to resolve the everyday issues we face. Look for the silver lining each day. This forced “Stay at Home” situation has opened up so many new avenues for us to grow and develop. The first and most significant advantage everyone is speaking about is the wonderful quality time that we are able to enjoy with our family. Family ties are getting stronger, lost friends are reconnecting, new skills are being learnt. Above all, many of us are rediscovering ourselves.

The third “A” is Adaptability. Evolution has proven that adaptation is the only way in which a species can survive. To mention an oft quoted cliché, it is the rule of the “Survival of the Fittest” that one needs to remember. Learn to adapt, to change with the situation. Once you have made yourself aware of the situation and accepted it for what it is, evaluate it and see what needs to be done to adapt to it. Learn new skills if you must, be it technology, communication, presentation, etc., equip yourself with the new skills required to function optimally. Build resilience and patience. Find new interests and hobbies. Increase, not just your physical immunity, but also your emotional resilience.

The final “A” in the tool kit is Appreciation. Appreciate what we have rather crib about than what we do not have. With so many people across the globe succumbing to the virus, we are indeed very fortunate that we are employed, safe, alive and healthy. Count your blessings, you’ll be surprised to know that your blessings outweigh and out number your woes. Think of all those who have lost their lives, or lost their loved ones; or lost their jobs; of those who are facing extreme financial difficulties; who are stranded so far from home; who do not even have a safe place to call “home”! We are fortunate and blessed. Therefore, let us appreciate this. Not just by sending up a prayer of thanks, but also by actioning that appreciation. Extend help and support wherever and whenever you can. Appreciate those who are working to sustain an element of normalcy, even during these bizarre times; those risking their lives to save that of others. Appreciate the educators who are burning the midnight oil to ensure that learning never stops. Appreciate the family that is providing you with a loving and safety net, so that your schedule for working from home or working for home is as seamless as possible.

Such is the power of Adversity. Therefore, rather than looking at adversity as a roadblock in our lives, we need to look at how we can use them as the proverbial steppingstones to take us further.

Those who do so, not only go further, they also grow stronger. It is the tough times that makes us innovate, improvise and invent. History has enough examples to prove this. Every invention created come into existence because a need was felt for it. The stronger the need, the faster the invention – or in the present scenario, the discovery.

The pandemic holds us in its grip and the entire planet has a single point agenda at the moment, and that is to find a vaccine that will help stop its spread. Cure, thankfully, is now a possibility.

Looking at the positive side of things, one can’t help but reflect on how, people around the world have put aside their differences and are all trying to support each other – nationwide and worldwide – in an attempt to what is now popularly being known as “flattening the curve”.

Bringing this to our context, how can we as parents and educators, strengthen our children and make them more resilient? A question that every adult is concerned about today.

So, first things first. One of the things the children definitely need to be able to build resilience is your complete faith and support. As parents, you need to be there for your children. Therefore, carve out time from your schedule, however busy you are and give them your complete and undivided attention. Make this time special and sacred. No gadgets, no phone calls, no TV viewing or even listening to music. Don’t couple this special time with chores to be done around the house. These conversations are very important and hence need to be given that stature.

Now, just because the time is to be considered sacrosanct and important, does not mean this is “serious” conversation time only. What it means is that all bodies are on “Listening Body” mode and each one gets a chance to talk and be heard.

Once this is established as a routine, you will notice that children become more vocal and start voicing their thoughts, emotions, concerns and anxiety. That is when you begin to steer the conversation towards becoming resilient.

Talk to them about the adversity that they (and you too) are facing and discuss each person‘s perspective. Watch as they come out with simple solutions to dealing with, not just the adversity itself, but also its effects on themselves and others.

Explain to them how it is important to face the adversity to be able to overcome it. Denying or evading it is what makes the adversity grow stronger or larger. Facing it upfront will result in one of two things – we either get stronger and hence are able to overcome it; or we are able to change the adversity into an opportunity and then optimize it to our advantage.

School Registration

You would be surprised to know that as per Indian laws, private organizations cannot open schools in India, just to ensure education does not happen solely for profit.

The schools in India must be in accordance with the Societies Act of 1860 or by a trust that has been organized as per the Public Trust Act of individual states.

A private entity willing to set up a school in India can also set up a company as prescribed by Section 8 of the Companies Act 2013.

Land For School

To build an educational institute school’s governing body must attain a NOC from the concerned state’s Department of Education.

On the other hand, the purchase of land from the government- for the school- will require to procure a no-objection certificate referred to as the Essentiality Certificate (EC)- which is an essential document certifying the requirement of an institute in the particular zone, and must take it from the concerned state’s Department of Education.

The Department of Education (DOE) has the authority to make the decision for a school in a particular zone.

The construction must commence within 3 years of obtaining the certificate, failing to which the society has to apply for renewal. The society needs to obtain a “letter of sponsorship” from the DoE.

School Affiliation

he affiliation for the school requires the Online application, which can be further submitted for the :

  • Approval of Middle-Class Syllabus/Affiliation or Switch Over upto Secondary level/ Upgradation or Switch Over to Senior Secondary level
  • Additional Subjects, applicable in case of already CBSE affiliated Senior Secondary schools.
  • Extension of Provisional Affiliation in case of already CBSE affiliated school upto Secondary / Senior Secondary level.
  • For non switch over cases, a school has to first affiliate itself with CBSE upto Secondary stage and run class IX for a minimum period of one year then applying for Upgradation to Senior Secondary level.
  • Affiliation fee has to be deposited by online banking/ debit card/credit card/NEFT.
  • Last date for submission of application is 30th June, of the year in which class VII, IX, XI is proposed to be started.
  • The classes must not be started without prior affiliation with the Board.
  • For the Extension cases, the schools who have missed the deadline last year can apply this year with a late fee.
  • For schools (applying late) who submit their application in January, the late fees is Rs 20000, however from 1 February, the late fee will be Rs 100000.

Once this application is submitted, then an inspection committee comes to conducting the detailed inspection matching the norms and condition, and on being satisfied with the facilities school affiliation is granted.

Why do we as parents behave the way we do? Often it is because we model our behavior on the behavior that we saw in our own parents. While being parented, we have imbibed and absorbed some of the behavior reflected by our parents.

Sometimes, information gathered from books on parenting and from discussion forums have guided us to choose a behavior or accept certain beliefs.

All of us as parents have some ideas about how a child is to be raised, what values need to be instilled in them and what goals need to be set for them, to prepare them for a highly competitive and ruthless world. These culturally shared ideas and how they develop are referred to as beliefs.

Since we live in social communities and each society is influenced by its unique culture, all that we learn from this culture influences our parenting as well.

“SHRI PARVARISH” The ABC of Parenting from The Heart “A” – Acceptance

“Raise the child you have got, not the one you want” is what author and parenting coach Nancy Rose advice in her book with the same name.

And, that is what this article is going to discuss, “Acceptance” – the ‘A’ in “The ABC of Parenting from the Heart”.

Accepting the child for what he or she is building a healthy parent-child relationship that is founded on trust and wellbeing. When the child has to constantly live up to expectations that are beyond his or her ability, there is discontent and conflict.

Not only does the child become reticent and withdrawn, his or her self-esteem and confidence is crushed under the pressure of comparison and competition.

We often mix up approval and acceptance in the belief that they are both the same. Well, they aren’t. As parents, we do not have to approve what a child does, but accepting that it has been done becomes important. We as parents may aspire and dream for our children. This is not a bad thing. However, when these take a precedence over what the child himself or herself aspire for and dream about, painful conflicts arise and destroy the fabric so carefully woven over the early years of the child.

So, how do we connect with our children when there are differences in temperament and aspirations? What questions do I need to ask myself to gauge whether I am an accepting parent? How do I avoid comparing my children when one has much higher needs than the other? What can I do to ensure that I can accept each of my children for their own personal uniqueness?

Here are some useful insights and tips:

  • Strike a balance between changing your child and accepting your child
  • Recognize the qualities in them that are intrinsic to them
  • Ask yourself if there anything more important to you than your child’s happiness
  • Recognize the strengths and virtue in each of your children and appreciate them
  • Love your children for themselves, not for the best of ourselves in them
  • Let your child/children know through words and action that you are there for them, loving them and accepting them, no matter what
  • Try to empathize with their differences, and to experience those differences on their terms rather than your own
  • Listen with full attention and focus on what your child is saying to you
  • Be an active listener
  • Communicate to the child without making judgments
  • Help the child become aware of the emotions he/she feels as this will enable them to make conscious choices on how to respond
  • Show empathetic concern towards your child as it shows them that you really care and are trying to understand them and their feelings; it shows them that you love them despite the situation and demonstrates your acceptance despite the behavior

One of the biggest challenges to being able to accept your child is holding onto unrealistic expectations of your child and yourself. Most parents agree that having a happy child that achieves within their capabilities, academically, socially, physically and emotionally, is their hope and dream. Just because your child is not like you doesn’t mean that they are not valuable and certainly doesn’t mean that you have failed in your role as a parent in any way.

Acceptance is fostered through understanding and knowing. Get to know what makes your child tick, what they love doing, what interests them, who they feel close to, what they want you to be doing with them, and what they want you to want for them.

Take turns in doing things together that you and your child enjoy and make time in your schedules to have fun together. Make space in your house to cater for your child, whether it be a spot for toys, music, games or books that interest him/her. To conclude, Acceptance in parenting is about being able to see and acknowledge the uniqueness in your child, without pressing for this to change.

As Andrew Solomon states, it is “finding the light in your child and seeing it there” that is important (Solomon, 2014). This, however, must not stop you from striving to shape your children’s behavior, educational outcomes, sporting ability etc., but rather, enable you to accept and validate with warmth their unique personality, and loving them for being them.

This indeed is the most beautiful role one would play in one’s life. A role that is lifelong and comes with no “exit clause”

This is an assignment that no amount of pre-reading or pre-discussions can truly prepare you for a 100%. And yet, most of us are able to find our own style and philosophy to ensure that the child’s upbringing is peppered with the right amount of “do’s” and “don’ts”, which hopefully ensure that he or she grows up to be someone we, as parents, could be proud of.

From the moment we hold our little bundle of joy in our arms for the first time,
our lives change dramatically, taking on a new meaning and purpose. From then on, we strive to provide our little one with everything money can buy. And of course, along with all these materialistic things are the other experiences and memories that we ill our child’s life with.

These experiences and memories are what he or she will look back on when faced with life decisions. Therefore, a parent with caution and compassion; a parent with empathy and sympathy; a parent with love and firmness; a parent with trust and faith. In the months that follow, we will be sharing with you various insights into positive parenting that will enable you, to some extent, to reduce anxiety and stress while interacting and transacting with your child. However, while these are experiences shared by many a parent, it is not a case of “one size fits all”. Therefore, it is imperative that what is read is read in context, understood completely, before strategies and techniques are used in similar situations. Remember, the situation may be similar, but the child is different. And hence, customizing these tips and strategies is important.
